Rights Under Healthcare and Health Financing Laws

We begin this discussion of rights-creating health laws with the Examination and Treatment for Emergency Medical Conditions and Women in Labor Act (also referred to as EMTALA, which is the acronym for the law’s original name—the Emergency Medical Treatment and Active Labor Act—or, for reasons soon to become clear, the “patient antidumping statute”). We then briefly discuss the federal Medicaid program in a rights-creating context and wrap up this section with a brief discussion of the ACA.

Rights Under Healthcare Laws: Examination and Treatment for Emergency Medical Conditions and Women in Labor Act

Because EMTALA represents the only truly universal legal right to health care in this country—the right to access emergency hospital services—it is often described as one of the building blocks of health rights. EMTALA was enacted by Congress in 1986 to prevent the practice of “patient dumping”—that is, the turning away of poor or uninsured persons in need of hospital care. Patient dumping was a common strategy among private hospitals aiming to shield themselves from the potentially uncompensated costs associated with treating poor and/or uninsured patients. By refusing to treat these individuals and instead “dumping” them on public hospitals, private institutions were effectively limiting their patients to those whose treatment costs would likely be covered out-of-pocket or by insurers. Note that the no-duty principle made this type of strategy possible.

EMTALA was a conscious effort on the part of elected federal officials to chip away at the no-duty principle: by creating legally enforceable rights to emergency hospital care for all individuals regardless of their income or health insurance status, Congress created a corresponding legal duty of care on the part of hospitals. At its core, EMTALA includes two related duties, which technically attach only to hospitals that participate in the Medicare program (but then again, nearly every hospital in the country participates). The first duty requires covered hospitals to provide an “appropriate” screening examination to all individuals who present at a hospital’s emergency department seeking care for an “emergency medical condition.” Under the law, an appropriate medical screening is one that is nondiscriminatory and that adheres to a hospital’s established emergency care guidelines. EMTALA defines an emergency medical condition as a

medical condition manifesting itself by acute symptoms of sufficient severity (including severe pain) such that the absence of immediate medical attention could reasonably be expected to result in (i) placing the health of the individual (or, with respect to a pregnant woman, the health of the woman or her unborn child) in serious jeopardy, (ii) serious impairment to bodily functions, or (iii) serious dysfunction of any bodily organ or part; or with respect to a pregnant woman who is having contractions, that there is inadequate time to effect a safe transfer to another hospital before delivery, or that transfer may pose a threat to the health or safety of the woman or the unborn child.20

The second key duty required of hospitals under EMTALA is to either stabilize any condition that meets the above definition or, in the case of a hospital without the capability to treat the emergency condition, undertake to transfer the patient to another facility in a medically appropriate fashion. A proper transfer is effectuated when, among other things, the transferring hospital minimizes the risks to the patient’s health by providing as much treatment as is within its capability, when a receiving medical facility has agreed to accept the transferred patient, and when the transferring hospital provides the receiving facility all relevant medical records.

The legal rights established under EMTALA are accompanied by heavy penalties for their violation. The federal government, individual patients, and “dumped on” hospitals can all initiate actions against a hospital alleged to have violated EMTALA, and the federal government can also file a claim for civil money penalties against individual physicians who negligently violate an EMTALA requirement.

Drew started working at Wow Fashions, a trendy high-class retail store for young professionals, three years ago. Drew has worked hard, and the Regional Manager recognized those efforts and recently promoted Drew to store manager. Along with this new responsibility, the Regional Manager expects Drew to be at the store weekdays and weekends and to work 50-55 hours per week. The Regional Manager knows how important it is to be in front of the customers. Drew has worked extremely hard to get to this point and has watched many people leave the company, but Drew sees continued growth. The pay and benefits are good, and they even have tuition reimbursement, which will assist with Drew’s long-term goal of completing a graduate degree in fashion. Drew’s Regional Manager has emphasized that being in front of the customers assuring they are happy with the products and services of the store to keep sales up and have continuous profitability is very important. Since Drew’s promotion, the Regional Manager has stated he expects store managers to work more hours, but Drew will only be paid for 40 hours a week. No matter how many hours Drew works now, there is no overtime pay because it is expected of store managers. This is creating more of a problem since now Drew is expected to dress nicer and more often because of the increase in working hours. To add a bigger barrier, Drew cannot even afford the clothing in the store with the ten percent employee discount, but the manager would like to see Drew wearing the store fashions.

Drew is at the store more and more but doesn’t feel like a manager. Drew spends most of the time checking out customers, stocking shelves, lifting boxes, taking lots of inventory, cleaning the store, and even cleaning the restrooms. It seems more like the work Drew did while in customer service before becoming a manager but now there is much more of it to do, and there wasn’t an increase in pay for doing more of it. Drew feels like this just was not part of the original job promotion. Drew feels there have been minimal opportunities to interview potential employees and train new hires. Since there has been quite a bit of turnover at the location, the Regional Manager has been involved in every aspect of hiring, firing, and all employment decisions without including Drew in the process. The corporate office has clear policies and procedures on how to handle all store issues and provides training to store managers but the Regional Manager controls everything, and the corporate office is rarely notified.

To help you understand this assignment further, the following description and examples may be useful.

Step 1: Define a doctrine and identify why a president would want to announce one. A doctrine is an ideological platform that a president uses to advance a policy towards a country or region in order to accomplish foreign policy goals for the United States, so you will need to expand on this theme. 

Refer back to Assignment 1 and build on whatever doctrine you wrote about then. Say, for example, you selected the Truman Doctrine. Therefore, this is the only thing you will write about in Assignment 2 step 1.

Step 2: Select one country you wrote about in Assignment 1 and describe the Cold War relationship that existed between it and the U.S. before the presidential doctrine was announced. 

In the case of Truman, you would pick either the Soviet Union, Greece, or Iran, because all three were affected by his doctrine. If you are writing about the Eisenhower Doctrine, you would choose Lebanon or Egypt; if you wrote about the Kennedy Doctrine, you would have write about Cuba or Vietnam; if your wrote about the Nixon Doctrine, you would choose either Vietnam, Saudi Arabia, or Iran; if you chose Carter, you would select either Iran or Afghanistan; and if you wrote about the Reagan Doctrine, you would select Nicaragua, Angola, Russia, or Afghanistan (although there were several others).

Step 3: Describe what effect the presidential doctrine you chose has had on regional or global affairs since it was announced during the Cold War. 

That is, how did the doctrine change the status quo regionally or globally after it was announced by the U.S.? What happened in Western Europe after the Truman Doctrine was announced? What happened in the Middle East after the Eisenhower Doctrine was announced? What happened with Cuba or Vietnam after Kennedy offered up his doctrine of flexible response? What happened in Southeast Asia or the Persian Gulf after the Nixon Doctrine went in effect? What happened in the Middle East after the Carter Doctrine was announced? What happened in Central America or Africa or the Middle East after Reagan announced his doctrine?

Step 4: Refer back to the country you selected in step two and describe the relationship that currently exists between the U.S. and that country.
