Crime Control Model
It places highlights on decreasing and preventing crime through increased prosecutorial and police powers. The power of the government to protect society is prioritized in this model. On individual rights, this model is less protective since this model believes that in order to maintain public safety the rights of individuals must be put aside. Those suspects thought to be guilty are pursued without checking the rights protecting the suspect. This model leads to fear of crime, and there is demand for quick justice. These can lead to increased measures for crime control. In recent years, this model has been applied in the criminal justice system such as the right of the police to hold a suspect in anti-terrorism without charge.
Due Process Model
This model believes in the principle that an individual cannot be stripped off the right of liberty, property, or life without authorized procedures. Under this model, when the suspect are accused, their rights are guarded by the criminal justice system through their right to get a fair trial and fairness before the law. The due process model is important since it ensures the innocent are removed the blame, and only the perpetrators are found guilty and punished. Its application is seen in Human Rights Act of 1998 that allows for practices in the criminal justice to be checked thoroughly from a human rights perspective.
The Structure of the Criminal Justice System
The justice system is a group of both state and federal organizations that are concerned with crime in states and country. These federal and state agencies are mandated to process suspects, defendants, and offenders who have been convicted. Decisions made in one agency affects the other agencies in the criminal justice system. The three branches of government, legislature, executive, and judiciary, are the basic framework for the criminal justice system.
